Corporate Visa

Applications for permanent residency in South Africa are considered in terms of Section 26 (Direct Residency Permits) and Section 27 (Residency-on-Other-Grounds Permits) of the Immigration Act 2002 (Act No 13 of 2002), and read with Regulation 33 of the Immigration Regulations.

Corporate Visa

A corporate visa grants a South African corporate entity the right to employ foreign nationals in their business. The number of foreign nationals to be employed will be limited and the positions in which they may be employed specified.

A corporate visa can take time to obtain, as it requires the corporate entity to explicitly demonstrate the need for foreign employees in the business, rather than local employees. The business must also prove that the conditions of the employment contracts are not inferior to those being offered to employees who are South African citizens or permanent residents. Only once the Department of Labour and the Department of Trade and Industry have given their recommendations will the corporate visa is considered by the Department of Home Affairs.

This being said, once the corporate visa has been obtained foreign employees may be issued visas in the various categories with little effort.

For what duration is a corporate visa valid?
A Corporate Visa can be issued for a maximum period of 3 years
